About Adding / Removing a tenant from a lease
There are times where tenants no longer wish to be on the lease together and they are requesting the contract to be updated to add, replace, or simply remove the tenant on the lease.
Although your current signed lease agreement may already provide the terms and conditions already in place, it can be changed should all parties agree to the change. It can be changed via a new lease being signed and/or signing an amendment to the lease with conditions to the new change. (Please check state rules)
So let’s say you do have a situation where tenants want to remove, switch, or add a person on the lease. It is recommended to do both processes listed above; all parties agree to the terms of the change and then a new lease is signed to keep the file clear and clean. You’ll first want to inform them in writing of your policy on how you as a landlord wish to handle this matter. Then send them the forms to come to an understanding/agreement. Once signed, it is best to have a new lease completed.
Leases with many signed changes and different names can make it more complicated should this transaction ever land in court. This is the main reason we always say keep a clean file with clear documents to avoid confusion. When there is confusion, lawyers could charge more, judges could give wrong opinion, and tenants can get angry quicker.
